Changes in federal immigration enforcement practices do not impact our legal responsibility to protect the rights and privacy of our students, staff and families. We will continue to follow MPS protocols, policies and state and federal laws, including the following:

MPS does not collect or maintain information about the immigration status of any student or their family members.
Staff must follow our guidance for enforcement action procedures.
The Family Educational Rights and Privacy Act protects the privacy of student education records and restricts the sharing of personally identifiable information without parental consent or a lawfully-issued subpoena or court order.

MPS has provided school leaders and appropriate school-based staff with guidance to handle potential interactions with immigration enforcement officials.

MPS will always do everything we can to support our students. We also recognize that families are concerned about the impact of immigration enforcement actions in our community. We encourage families to review the resources from the City of Minneapolis.

Know Your Rights

Be Prepared

Emergency Contacts: Make a list of important phone numbers, including family members, friends and local organizations that can provide assistance. Keep this list in an easily accessible place. Update your school with these contacts.
Family Plan: Discuss and create a plan with your family. Decide on a safe place to meet and how to communicate if you are separated.
Important Documents: Keep copies of important documents (e.g., passports, birth certificates, medical records) in a safe and accessible place. Consider storing digital copies securely online.
Consider a Delegation of Parental Authority (DOPA): A DOPA is a document that allows you to designate someone to take care of your children if you are unable to do so. See this information from the Volunteer Lawyers Network.

The State of Minnesota Human Rights Act

Prohibits discrimination in employment, housing, public accommodations, public services, education, credit, and business based on protected class, such as race, religion, disability, national origin, sex, marital status, familial status, age, sexual orientation, and gender identity.

The MN Data Practices Act

Provides guidance on all data collected, created, received, maintained and disseminated by any government entity.

Establishes clear procedures and safeguards for our students concerning requests from external agencies seeking to interview students.

Policy 1304, Equity and Diversity

Addresses equity and inclusion for all students, staff, and families. This policy establishes equity as an essential value in our governance, leadership, policies, programs, operations, and practices.

Policy 1480, Visitors To District Buildings And School

An individual or group may be denied permission to visit a school or school property or permission may be revoked if the visitor(s) does not comply with school district procedures or if the visit is not in the best interest of students, employees, or the school district.

Policy 5000, Equal Educational Opportunity

Ensures equal educational opportunity for all students, regardless of race, religion, national origin, sex, gender, gender identity and expression, ability, sexual orientation, or age.

Policy 5025, Gender Inclusion

Students and staff are protected from discrimination on the basis of sex pursuant to Title IX of the Education Amendments of 1972 and the Minnesota Human Rights Act.

Policy 5620, Releasing Students To Police

Outlines procedures for access to students by police officers during the school day, and responsibilities of district staff in responses to requests from law enforcement officers to question students or to release students to them.

Policy 5690: Student Data

Safeguards students’ private information and ensures adherence to relevant data privacy laws.
